AB 1629 changes noncontracted dental assignment of benefits

AB 1629 creates a direct-payment pathway for covered noncontracted dental services when an assignment meets statutory safeguards. Existing out-of-network benefits, voluntary consent, and limits on advance collection remain central to the transaction.

What happened

A plan or insurer covering out-of-network dental services must pay the noncontracting provider directly when a compliant assignment of benefits is submitted. The provider definition includes registered dental hygienists in alternative practice. The payment remains governed by the member's covered benefit; the assignment does not itself add an out-of-network benefit or guarantee that a proposed treatment is covered. The plan section excludes Medi-Cal managed care contracts, including dental managed care.

Before obtaining assignment, the provider must disclose noncontracted status, potentially lower in-network costs, estimated treatment and member costs, possible coverage limits, and the member's right to confirm benefits. Assignment is optional and may be revoked in writing for services not yet rendered. Signed, dated consent must be retained, although it need not accompany the assignment when that record is maintained. Before carrier payment, the provider may collect only estimated cost sharing or an approximating deposit. Payment-routing changes therefore require consent and collection controls alongside claim submission.
