AB 1876 strengthens health plan nondiscrimination protections
Oct 11, 2026 edition · GC-2026-0068 · Published 2026-10-11 · Version 3 · Final
AB 1876 adds state plan and insurer nondiscrimination protections, with ordinary January 1, 2027 effectiveness. Protected status cannot justify discriminatory benefit or claim restrictions, while legitimate clinical and coverage standards remain.
What happened
The law protects enrollment and benefits on race, color, national origin, age, disability, and sex, including intersex traits, pregnancy, sexual orientation, and gender identity. It prohibits discriminatory benefit designs, claims restrictions, cost sharing, and categorical gender-transition exclusions. Disability protections include appropriate integrated settings and serious risks of institutionalization or segregation.
Legitimate nondiscriminatory clinical appropriateness, coverage requirements, and reasonable medical management remain permitted; bias or pretext does not. Plans and insurers must provide nondiscrimination and grievance information. These protections do not guarantee every service regardless of medical necessity. The ordinary January 2027 date is grounded separately in the official constitutional effective-date rule.
