AB 350 expands fluoride treatment coverage and guidance
Oct 11, 2026 edition · GC-2026-0057 · Published 2026-10-11 · Version 3 · Final
AB 350 separates qualifying commercial fluoride-varnish coverage from Medi-Cal implementation guidance. Its commercial contract trigger is January 1, 2027, while DHCS has a July 1 guidance deadline and must preserve training, supervision, and federal approval conditions.

What happened
For qualifying contracts or policies issued, amended, or renewed from January 1, 2027 that already cover pediatric fluoride varnish, AB 350 requires medically necessary application without cost sharing whether billed as medical or dental care. Specialized coverage and Medicare supplements are excluded, and Medi-Cal managed-care contracts are excluded from the commercial plan provision. If the new requirement creates state benefit-defray obligations without an appropriation, the specified commercial requirement ceases to apply. The bill does not erase existing federal preventive-service obligations.
For Medi-Cal beneficiaries under 21, DHCS must issue billing guidance and necessary policy updates by July 1, 2027 consistent with EPSDT and utilization controls. The provision allows place-of-service flexibility, but qualified professionals must act within scope, complete appropriate training, and work under an enrolled licensed provider who bills for their services. That provider must retain training records for review or audit. Community health workers are included, with other nonlicensed practitioners dependent on DHCS designation. Implementation remains conditioned on available federal participation and necessary approvals, rather than independent billing authority for every trained staff member.
