ACWDL 26-16: Pickle, DAC and DW asset-limit reinstatement

ACWDL 26-16 restores asset testing for Pickle, DAC, and DW through different application, renewal, and change rules. Protected periods, cure rights, and staged LTC review prevent a universal January 1 retest of existing members.

What happened

The September 17 letter restores January 1, 2027 limits of $130,000 for one person plus $65,000 per additional person, up to ten. New applications face asset verification; pre-January applications and earlier retroactive months remain protected. Existing members are tested at renewal or a qualifying change with assets verified ex parte, rather than all being retested January 1.

A qualifying 90-day cure restores timely eligibility. Property eligibility generally uses 12:01 a.m. on the first day, with distinct spenddown and medical-expense settlement rules. LTC transfer review excludes January 2024–December 2026 and grows to a full 30 months by July 1, 2029. These transition conditions require separate application and renewal workflows.
