OIG flags organ acquisition reimbursement and documentation risks

OIG estimates about $380 million in organ-acquisition reimbursement outside Medicare-covered transplants during 2017–2022 and separately identifies $154,210 without supporting records. Its recovery and guidance recommendations have different CMS responses and remain distinct from a completed refund.

What happened

OIG's audit, issued September 1 and posted September 3, examines organs reported as Medicare usable during 2017–2022. In a sample of 180 organs, Medicare reimbursed acquisition costs for 43 not used in Medicare-covered transplants and 12 not transplanted at all. OIG extrapolates about $380 million across the six-year period. It identifies a conflict between statutory limits and CMS guidance that assumes organs furnished to another transplant center or procurement organization will be used for a Medicare transplant.

Two centers also lacked support for five organs, producing a separate $154,210 unallowable-reimbursement finding. OIG recommends MAC recovery of that amount and revision of CMS guidance to count only organs transplanted into Medicare enrollees. CMS concurred with the recovery recommendation but did not specifically concur or nonconcur with the guidance recommendation; the retained tracker shows both open. The nationwide estimate, the two-center documentation finding, and a later entity-specific collection must therefore remain separate when assessing records and reimbursement exposure.

Why it matters

The estimate is not a blanket recoupment notice. Transplant centers face a documented conflict between CMS guidance and statutory requirements identified by OIG.
