SB 1049 gives qualifying claim corrections a minimum filing period

SB 1049 protects a qualifying corrected claim for at least ninety days after the carrier's most recent action. Its filing and dispute protections depend on a remediable defect, rather than excusing every late original claim.

What happened

The new parallel plan and insurer sections apply when a claim denial, partial denial, or overpayment notice rests wholly or partly on a defect that can be fixed through a corrected claim. The claimant receives no less than ninety calendar days from the carrier's most recent action to submit the correction. That trigger is the relevant carrier action, rather than automatically the original service date or the date of the first rejection in a longer claim history.

A qualifying correction filed within that period cannot be denied for missing another otherwise applicable claim-filing deadline. Related disputes must be eligible for the carrier's dispute-resolution mechanism. The act also authorizes department guidance and necessary regulations, including consistent DHCS guidance under the plan provision. These safeguards preserve a route to correct and dispute an eligible defect; they do not establish that the corrected claim is medically necessary, covered, or automatically payable on its merits.
