SB 964 creates a qualifying drug dose adjustment request pathway

SB 964 allows a treating contracting provider to request qualifying dose or frequency authority for an already covered drug. The seventy-two-hour response rule depends on the request establishing each statutory condition; it is not a general authorization repeal.

What happened

A written request may seek authority to adjust dose or frequency to the member's medical needs without further prior authorization or utilization management. The carrier must respond in writing within seventy-two hours of receipt and authorize when the request establishes prior coverage for the member's serious chronic condition or cancer, continued prescribing for that condition, exclusion of opioids and scheduled controlled substances, and the limit on earlier adjustments. The provision specifically uses a treating contracting provider, rather than any person asking to change a prescription.

The statutory limit is that the dose has not already been adjusted more than twice without prior authorization. For an off-label drug or adjusted use, the separate referenced coverage conditions must also be satisfied. Medi-Cal managed care is excluded from the plan section. These gates support a documented pathway for qualifying ongoing treatment, but do not establish automatic approval from carrier silence, eliminate every future review of an unqualified adjustment, or authorize changes outside the prescribing clinician's responsibility.
