AB 1794 permits specified home enteral nutrition arrangements
Oct 4, 2026 edition · GC-2026-0066 · Published 2026-10-04 · Version 2 · Final
AB 1794 authorizes specified arrangements to deliver therapeutic enteral nutrition directly to a patient’s home. The final pathway requires a valid prescriber order and pharmacist services consistent with accepted standards of care and does not erase the surrounding pharmacy framework.
What happened
California enacted AB 1794 on September 27, adding a home-delivery pathway in Business and Professions Code section 4059(i). A pharmacist, manufacturer or wholesaler may participate in an arrangement or agreement to deliver enteral nutrition supplements or replacements directly to the patient’s residence. Delivery must be pursuant to a valid order from a prescriber acting within their scope and in accordance with pharmacist services and activities consistent with the accepted standard of care under the cited pharmacy provisions. The enactment is the event reported here; the applicable commencement of these provisions must be confirmed separately.
The defined products are medical food used as a therapeutic regimen to prevent serious disability or death in patients with diagnosed conditions that preclude full use of regular food. That definition and the order and pharmacist conditions limit the pathway; the provision is not a general permission to furnish prescription products without pharmacy controls. The surrounding section retains distinct dangerous-drug and device rules and a separate direct-distribution framework for home dialysis products, which should not be substituted for the new enteral-nutrition conditions.

Why it matters
Fulfillment agreements need to identify the qualifying product, valid order and pharmacist role. A manufacturer’s participation in home delivery does not by itself resolve clinical oversight or the separate rules for other drugs and devices.
Recommended action
Confirm the applicable commencement before treating the new provisions as current duties. Prepare the following for implementation at that commencement: Have Pharmacy review product eligibility, prescribing orders, supply agreements, direct-home delivery and pharmacist oversight. Retain documentation of the standard-of-care pathway and distinguish enteral nutrition from dialysis and other prescription-product fulfillment.
