AB 1864 requires qualifying nucleic acid synthesis screening

AB 1864 ties covered nucleic-acid synthesis providers and equipment manufacturers to the September 2024 federal screening framework and public compliance attestations. It fixes that framework version, distinguishes mandatory from recommended wording and excludes customers acting solely as customers.

What happened

California enacted AB 1864 on September 30, adding Health and Safety Code sections 24200-24204. A covered manufacturer may not produce benchtop nucleic-acid synthesis equipment in California or sell or deliver it to a California customer without following the specified screening framework and publicly posting its compliance attestation. A provider faces parallel duties for synthetic nucleic acids subject to screening. Definitions of manufacturer, provider, customer, equipment and screened nucleic acids come from the National Science and Technology Council framework as revised in September 2024. Later federal revisions do not automatically change the version incorporated into this state law. The enactment is the event reported here; the applicable commencement of these provisions must be confirmed separately.

The law makes framework provisions using “should” mandatory for covered providers and manufacturers, while “encouraged” remains a recommendation. Provisions the framework states take effect only on or after October 13, 2026 have no effect under this chapter before October 13, 2027. Violations can draw Attorney General civil actions and penalties up to $5,000 per continuing day, depending on severity. Customer activities, including listed medical and pharmaceutical research and production uses, are not regulated by this chapter when the customer is not also acting as a provider or manufacturer. A clinical or research laboratory’s purchase therefore does not itself establish manufacturer status.

Why it matters

Research and laboratory procurement can depend on a supplier’s screening and attestation, but the institution’s own role determines direct coverage. The fixed framework version and delayed subset of provisions also matter when reviewing vendor assurances.
