OIG identifies weaknesses in oversight of contract nursing home surveyors
Oct 4, 2026 edition · GC-2026-0021 · Published 2026-10-04 · Version 2 · Announced
OIG’s contract-surveyor audit found gaps in CMS oversight and improvement opportunities in all 14 surveyed states. Its recommendations concern recording surveyor employment status and verifying state controls; the report does not itself create a new nursing-facility filing deadline.
What happened
OIG issued its audit on September 2 and posted it September 4, finding that CMS did not adequately oversee state survey agencies’ use of contract surveyors for nursing homes. The audit describes increased contractor reliance amid staffing shortages and survey backlogs. Although CMS issued a memo on contracting practices during the audit period, it did not monitor whether state procedures achieved the guidance’s objectives. All 14 surveyed states using contract surveyors could improve policies and procedures to meet those guidelines.
OIG recommended adding employee-versus-contractor classification to CMS’s quality improvement and evaluation system and confirming state controls that ensure contract surveyors meet federal requirements. CMS concurred with both recommendations. The report links weak monitoring to increased risk of inadequate controls, rather than declaring every contractor survey invalid or every state noncompliant in the same way. These are agency oversight recommendations and background for survey administration, without a new facility deadline in the audit itself.

Why it matters
Facilities may encounter surveyors employed through different arrangements, but contractor status alone does not resolve the survey’s validity. Complete survey records and accurate handling of requests remain useful while CMS and states address the oversight findings.
Recommended action
Maintain survey-response records and monitor CMS implementation applicable to the facility. Route specific surveyor qualification concerns through the appropriate review process rather than presuming contractor involvement invalidates the survey.
