California requires county procedures for involuntary-commitment designations
Oct 4, 2026 edition · GC-2026-0114 · Published 2026-10-04 · Version 2 · Final
SB 16 requires county designation procedures to include emergency physicians among professionals eligible for specified 5150 functions. Eligibility does not replace training, application, approval or revocation requirements, and the county retains authority to set consistent criteria.
What happened
California enacted SB 16 on September 18, amending Welfare and Institutions Code section 5121 under the ordinary January 1, 2027 effective-date rule. County behavioral health directors must establish and implement procedures for designating and training professionals who perform section 5150 functions. The procedures cover eligible disciplines and experience, initial and continuing training and testing, application and approval, renewal and monitoring. The amended text requires emergency physicians to be included among eligible practice disciplines, defining them by emergency-department screening and treatment in a general acute care hospital.
Emergency physicians remain subject to the training, application, approval and revocation processes that apply to other eligible professionals. A county may retain consistent designation criteria, and its monitoring process may be a passive system responding to complaints and grievances as the statute permits. Denial or revocation requires written reasons to the specified requester and affected person. The section also preserves transportation authority for designated mobile-crisis members and professional persons and a distinct Sacramento provision. Eligibility for designation should therefore not be represented as automatic authorization for every emergency physician.

Why it matters
Hospitals depend on an actual county designation and documented training when assigning custody-related functions. New eligibility can expand a potential workforce while leaving local approval and renewal processes material.
Recommended action
Obtain each relevant county’s procedures and inventory actual designations, training and renewal dates. Evaluate eligible emergency physicians and prepare applications before relying on the authority. Preserve written denial, revocation and monitoring records and align hospital protocols with the county’s approved process.
