NRC expands exempt-quantity licensing rules, subject to November 4 adverse comments
Oct 11, 2026 edition · GC-2026-0315 · Published 2026-10-11 · Version 3 · Final
NRC's October 5 direct final rule expands certain materials-licensing exemptions, with December 21 effectiveness conditional on the absence of significant adverse comments by November 4. The accompanying proposal and retained quantity exceptions limit how that change can be applied.
What happened
The direct final rule amends regulations for byproduct, source, and special nuclear material to expand specified licensing exemptions. It is scheduled to take effect December 21 unless significant adverse comments received by November 4 cause withdrawal, which NRC would announce in the Federal Register. A companion proposed rule uses the same November 4 comment date, and comments on the direct final rule also count toward that proposal. This conditional procedure matters when describing the rule's status on October 11.
For byproduct quantities, revised Schedule B points to appendix C to 10 CFR part 20, with exceptions retained in 30.71(b): 10 microcuries each for cadmium-109, iridium-192, and zirconium-93, plus the specified 0.1-microcurie floor for other non-alpha-emitting material. NRC connects the update with research, academic, industrial, and medical uses and separately limits expanded DOE-contractor exemptions to defined activities and controls. These provisions do not exempt all clinical nuclear-medicine activities. Applicable material, quantity, contractual conditions, and Agreement State requirements must still be distinguished.

Why it matters
Medical and research users may have low-quantity materials within the revised limits. Existing exceptions preserve certain thresholds, including cadmium-109, iridium-192 and zirconium-93. This is not a general exemption for clinical nuclear-medicine practice. Agreement State compatibility and jurisdiction must be assessed separately.
Recommended action
Radiation-safety owners should inventory affected radionuclides and activities, compare precise exempt thresholds and existing license conditions, and consider comments by November 4. Confirm final effectiveness and applicable state adoption before relying on an exemption. The separate DOE-contractor training exemption is limited to qualifying activities and quantities.
