OIG identifies weaknesses in oversight of contract nursing home surveyors

OIG found gaps in CMS oversight of states' use of contract nursing-home surveyors, with improvement opportunities in every surveyed state. CMS concurred with two recommendations; the retained OIG page lists both as open and unimplemented, with March 2027 updates expected rather than a new provider filing deadline.

What happened

OIG's report issued September 2 and posted September 4 examines CMS oversight of state agencies using contract surveyors for nursing-home surveys. It found that CMS had issued guidance on contracting practices but did not monitor whether states implemented controls achieving the guidance's objectives. All 14 surveyed states that used contractors could improve policies and procedures for meeting the federal requirements. OIG describes the resulting risk as insufficient assurance that contractor surveyors meet those requirements, not a determination that every contractor-conducted survey is invalid.

The recommendations ask CMS to add employee-versus-contractor status to iQIES records for survey personnel and confirm that state agencies have policies and procedures ensuring contractor compliance, for example through annual state-agency assessments. CMS concurred with both. The retained recommendation entries show open, unimplemented status and an expected March 1, 2027 update. Those entries address agency oversight and follow-up; they do not impose a March provider submission, announce completed CMS implementation, or automatically set aside existing survey findings.
